Legal Fee Dispute

Concerned about the legal fees you've been charged? You may have options.

Disputes over legal fees can arise for a variety of reasons. You may believe you have been overcharged. You may disagree with the value of the services provided. You may be dissatisfied with the result achieved or lack thereof. You may believe the amount of time incurred on your legal matter is excessive, or the work performed provided little or no value to your case, or you may have concerns about the terms of your retainer agreement.

At KSW Lawyers, we understand that disagreements over legal fees can be stressful and financially challenging. Our team can assist clients in navigating legal fee disputes, understanding their rights and pursuing a fair resolution in accordance with British Columbia's Legal Profession Act.

Whether you are questioning an outstanding bill, disputing the terms of a retainer agreement or seeking to recover fees you have already paid, we can help you understand your options and guide you through the process.

Can I Challenge My Lawyer's Bills?
Yes, clients have the right to challenge the reasonableness of their lawyer's fees, charges and disbursements.

If you believe your lawyer's bill is excessive, contains unreasonable charges, does not accurately reflect the services provided, or legal services were not performed according to your instructions,  you may be entitled to have the bill reviewed by a Registrar of the Supreme Court of British Columbia.

A Registrar conducting a fee review consider various factors listed in s. 71 of the Legal Profession Act, including,
  1. (a) the complexity, difficulty or novelty of the issues involved,
  2. (b) the skill, specialized knowledge and responsibility required of the lawyer,
  3. (c) the lawyer's character and standing in the profession,
  4. (d) the amount involved,
  5. (e) the time reasonably spent,
  6. (f) if there has been an agreement that sets a fee rate that is based on an amount per unit of time spent by the lawyer, whether the rate was reasonable,
  7. (g) the importance of the matter to the client whose bill is being reviewed, and
  8. (h) the result obtained.
Note that the discretion of the registrar is not limited by the terms of an agreement between the lawyer and the client. If the Registrar determines that the fees charged were unreasonable by applying the factors set out in s. 71 of the Legal Profession Act, then the bill may be reduced and a refund may be ordered where appropriate.
Time Limits to file for a Fee Review
It is important to understand that strict time limits apply to challenging legal fees. If the bill has not been paid then you have 12 months from the date the bill was delivered to you. If the bill has been paid then you have 3 months from the date you paid the bill.

However, even if you appear to be out of time, the Court can extend the time for reviewing the bill if you can show special circumstances, a term that has been judicially defined. You will need to consult a lawyer to see if you can overcome the three month limitation by establishing special circumstances.
‍
For this reason, it is important to seek legal advice as soon as possible if you believe you have been improperly charged.
Costs in a Fee Dispute?
The responsibility for legal fees and costs will depend on the nature of the dispute and the process used to resolve it.
‍
For a formal review of a lawyer's bill by a Registrar of the Supreme Court of British Columbia, the Legal Profession Act establishes rules regarding who pays the costs of the review.
‍
Generally, if the lawyer's bill is reduced by one-sixth or more, the lawyer is responsible for the costs of the review. If the reduction is less than one-sixth, the person challenging the bill is generally responsible. The Registrar may exercise discretion in special circumstances.
‍
If the dispute proceeds through a separate court action, different rules regarding legal costs may apply.

I can't recommend this firm enough. I came to Eoin Logan after a really difficult experience with a former immigration consultant, feeling frustrated and unsure if anything could be done. From our very first conversation, I felt genuinely heard and supported. Eoin took the time to understand my situation, explained everything clearly, and guided me through the entire process of pursuing a claim with patience and professionalism. Thanks to his hard work and dedication, we reached a settlement I'm truly happy with. I'm so grateful I found Eoin, and I'd encourage anyone who's had a bad experience with an immigration consultant not to be afraid to seek help. Thank you for standing by me every step of the way.
