A Note on No Fault Motor Vehicle Claims
Effective April 1, 2022, the British Columbia government enacted legislation that significantly limited the rights of British Columbians to seek compensation through a lawsuit in the event of a motor vehicle accident within the province. This legislation completely eliminates the option for compensation from the at-fault driver, except for specific circumstances such as when the at-fault party has been criminally convicted of impaired driving. Instead, individuals injured in accidents after May 1st, 2021 may be entitled to benefits in amounts pre-determined by ICBC. Disputes over benefit entitlements will not be overseen by the courts, rather they will be handled by an ICBC fairness officer, ombudsperson, or the government-managed Civil Resolution Tribunal (CRT). As a result of this change, the access to legal representation for British Columbia residents involved in car accidents has been greatly affected.
