Insurance Denials

You get insurance so you have peace of mind that if something goes wrong, you and your family are protected and provided for. But if your claim is denied and your insurer resists payment -- no matter the reason -- it can be frustrating and sometimes even devastating.

If your claim has been denied, the insurance lawyers at KSW Lawyers can help you file an appeal or a legal claim, and pursue the benefits you paid for in good faith. We’ve represented clients at all levels of court since 1973, and have an outstanding track record of successful results  for our clients.

Our Insurance Lawyers

With decades of experience, up-to-date knowledge of the field and meticulous attention to detail, our insurance lawyers can help you navigate the claims appeal process in pursuit of the benefits you’re entitled to.

Life & Disability

Life insurance and disability claim denials hit you at your most vulnerable time -- right after the loss of a loved one, or when your whole life may be radically changing due to an injury. Fortunately, a denied claim isn’t the end. Depending on the terms of your policy, the insurance lawyers at KSW Lawyers can help you fight to protect yourself and your family.

Disability Insurance

Disability insurance (short-term and long-term) can help protect an individual and his/her family from an unexpected illness or accident that leaves a person unable to work and earn an income.

Generally, disability insurance replaces between 60% and 85% of one's regular income. LTD insurance benefits generally begin when the following benefits end:
- short-term disability insurance;
- sick leave benefits from your employer; and
- employee insurance ("EI") benefits.

Long Term Disability Benefits (“LTD”)

Most LTD plans will replace 60% to 70% of an individual's normal income. Each disability plan is different. Some may provide disability benefits for up to 2 years if a person is unable to return to the job he/she had before becoming disabled. After 2 years, a person may continue to receive benefits only if he/she is unable to work at any job.

Unfortunately, a lot of times the insurance company might deny someone’s application for disability benefits, even when it is a legitimate claim. This is where our experienced Disability Lawyers team can jump in and represent your interest, obtain the necessary medical examinations and opinions, and get retroactive and future benefits for you.

The KSW Disability Team takes most of these files on a contingency basis, meaning you don’t pay anything until you get a settlement!

Property & Fire

Property damage at your home can be devastating -- even more so when your claim is denied, and you are left uprooted, sometimes with nowhere to go. If your insurer is resisting your claims, or has denied them outright, the team at KSW Lawyers is here to help advise you on your best course of action, preventing future issues, and claiming the benefits you are entitled to under your policy.

Occupiers Liability

The Occupiers Liability Act holds property owners accountable, ensuring that anyone using their property is not exposed to unreasonable risk. If you’ve been injured because of someone else’s negligence, our team can help you obtain fair compensation for your injuries.
